Ahead of Guy Fawkes Day, traditionally celebrated on 5 November, Drakenstein Municipality reminds all residents that discharging fireworks remains strictly prohibited within the municipal boundaries.
The Drakenstein Municipal Council approved this ban on fireworks in 2021, with the exclusion of pre-approved, controlled events. The decision followed widespread calls from residents, animal welfare organisations and the business community to curb the harmful impact of fireworks. The ban remains firmly in place in 2025.
The Municipality considered the significant risks associated with fireworks - including physical harm and distress to children, senior citizens and animals, as well as fire hazards and environmental damage.
The Municipality’s Control of Fireworks Bylaw allows for written permission to be granted by the City Manager - in consultation with the Executive Mayor - for special, pre-approved events such as major sports gatherings or cultural and religious festivals (e.g., Diwali).
The South African Police Service (SAPS) and Drakenstein Municipality’s Law Enforcement division will strictly enforce the bylaw and confiscate any fireworks found in illegal possession. Offenders will face fines and possible prosecution.
In terms of the Explosives Act (Act 26 of 1956):
- Using or detonating fireworks in any building or public place is liable to a R200 fine;
- Selling fireworks to anyone under 16 years is liable to a R300 fine; and
- Allowing a person under 16 to handle fireworks without adult supervision is liable to a R300 fine.
Under Drakenstein Municipality’s Fireworks Control Bylaw No. 1/2002, anyone contravening its provisions may face a fine of up to R1 000 or imprisonment for up to six months.
